Eminent Domain/Condemnation

Eminent domain is a law that extends power to the government to take private property for public use.  The law protects private property owners whose interests are threatened by governmental action, or whose property is being taken for public use under the government’s power of eminent domain, such as the power company, department of transportation, municipal association, and local, city, or state governments.  Any government department is generally referred to as an agency in eminent domain cases.

The government’s power of eminent domain can be intimidating to a property owners facing the prospect of condemnation or having their property acquired for a public project.  The acquisition of property by condemnation can be disruptive to personal lives and to business.

Eminent domain/condemnation issues

Many issues can come into play in an eminent domain action, all requiring complex court proceedings:

  • The agency can offer compensation that you do not deem to be fair, requiring you to go to court against the agency to prove your claims.
  • The agency only wants a portion of your property, leaving you with a portion that you cannot use.
  • You are unable to reach agreement with the agency, causing them to institute condemnation proceedings within the federal or state court.
  • You feel the agency has taken your property without paying just compensation, and you want to initiate an inverse condemnation action in court.
